Terms of Service

1. Acceptance of Terms

By creating an account or using AI Spark ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users including free trial users, subscribers, and visitors.

We may update these terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated terms. Material changes will be notified by email to active subscribers.

2. Eligibility

• You must be at least 18 years of age to use AI Spark.
• You must have the legal capacity to enter into a binding contract in your jurisdiction.
• The Service is intended for users who understand the risks of trading financial instruments.
• By registering, you confirm that you meet these requirements.

3. Not Financial Advice

AI Spark is an educational and informational tool only. All signals, patterns, and analysis provided by the platform are generated by automated algorithms and are:

• Not investment advice or financial recommendations
• Not a solicitation to buy or sell any security or instrument
• Not guaranteed to be accurate, complete, or timely
• Subject to the inherent limitations of algorithmic pattern detection

You are solely responsible for your own trading decisions. Always consult a qualified financial advisor before making investment decisions.

4. Account Registration & Security

• You must provide accurate, current, and complete information when registering.
• You are responsible for maintaining the confidentiality of your password.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at support@aisparktrade.com if you suspect unauthorised access to your account.
• Accounts are for individual use only. Sharing your account credentials is prohibited.

5. Subscriptions & Payments

• Free trial — New users receive a limited free trial. No credit card required to start a trial.
• Paid plans — Subscription fees are billed in advance on a monthly or annual basis via Stripe.
• Automatic renewal — Subscriptions renew automatically unless cancelled before the renewal date.
• Cancellation — You can cancel your subscription at any time via the Settings page. Access continues until the end of the current billing period. No refunds are issued for partial periods.
• Price changes — We reserve the right to change pricing. Existing subscribers will receive 30 days' notice before any price increase.
• Failed payments — If payment fails, access may be suspended until payment is resolved.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Scrape, crawl, or systematically download data from the platform
• Reverse engineer, decompile, or disassemble any part of the Service
• Share, resell, or redistribute signals or data from the platform to third parties
• Use automated tools to access the Service beyond normal usage
• Post false, misleading, or harmful content in community features
• Impersonate any person or entity

Violation of these terms may result in immediate account termination without refund.

7. Intellectual Property

All content, algorithms, code, designs, and data on AI Spark are the intellectual property of AI Spark and its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your personal, non-commercial use only.

You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

8. Limitation of Liability

To the maximum extent permitted by law:

• AI Spark is provided "as is" without warranties of any kind, express or implied.
• We do not warrant that the Service will be uninterrupted, error-free, or that signals will be accurate.
• We are not liable for any trading losses, financial losses, or consequential damages arising from your use of the Service.
• Our total liability to you for any claim arising from these terms shall not exceed the amount you paid us in the 3 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless AI Spark, its officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these terms, or violation of any applicable law or third-party rights.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms, fraudulent activity, or any reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. Provisions regarding liability, intellectual property, and indemnification survive termination.

11. Governing Law

These terms are governed by and construed in accordance with applicable law. Any disputes arising from these terms shall be resolved through good-faith negotiation first, followed by binding arbitration if necessary. Nothing in these terms prevents either party from seeking injunctive relief in a court of competent jurisdiction.
